1. Agreement to Terms

By accessing or using Actually Useful ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

Actually Useful provides custom automation engineering services on a subscription basis. Our services include:

  • Custom Python automation development
  • API integration and workflow automation
  • Code deployment to client repositories
  • Technical consultation and support

3. Subscription Terms

3.1 Billing

Subscriptions are billed monthly at $3,995/month. Payment is processed through Stripe. Billing occurs on the same day each month from your initial subscription date.

3.2 Service Delivery

  • One active build at a time with approximately one-week turnaround
  • Unlimited requests in queue
  • Code delivered to your GitHub repository
  • Full code ownership upon delivery

3.3 Pause or Cancellation

You may pause or cancel your subscription at any time. Pauses and cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

4. Intellectual Property

4.1 Code Ownership

All code written specifically for your project becomes your property upon delivery. You receive full ownership and rights to use, modify, and distribute the code as you see fit.

4.2 Pre-existing Code

We may use pre-existing libraries, frameworks, and code snippets that are subject to their own licenses (typically open-source). These remain under their original licenses.

5. Service Guarantee

If a delivered build does not work as specified, we will fix it within your active request slot at no additional charge. This guarantee covers functional defects based on agreed specifications, not scope changes or new requirements.

6. Client Responsibilities

You agree to:

  • Provide clear requirements and specifications for each request
  • Provide necessary API keys, credentials, and access in a secure manner
  • Respond to clarification questions in a timely manner
  • Maintain a GitHub repository for code delivery
  • Test delivered code in your environment

7. Confidentiality

We treat all client data, code, and business information as confidential. We will not share, sell, or disclose your information to third parties except as necessary to provide the Service or as required by law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACTUALLY USEFUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Acceptable Use

You may not use our Service to:

  • Create automations for illegal activities
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Send spam or unsolicited communications
  • Scrape websites in violation of their terms of service
  • Access systems without authorization

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify active subscribers of material changes via email. Continued use of the Service after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
